1. ACCEPTANCE OF TERMS

By downloading, installing, or using the PocketCoach mobile application (“App,” “Service”), you (“User,” “you”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. These Terms constitute a legal agreement between you and D Jungle People Sdn Bhd (“Company,” “we,” “us,” or “our”).

If you do not agree to these Terms, do not use PocketCoach.

1.1 Service Description

PocketCoach is an AI-powered coaching platform that provides professional development, leadership guidance, and mentoring services through mobile technology. The Service uses proprietary coaching frameworks developed by D Jungle People over 25 years of industry experience.

1.2 Eligibility

·       You must be at least 18 years old to use PocketCoach

·       You represent that you have the authority to enter into this agreement

·       Use is subject to applicable laws in your jurisdiction

 

2. SERVICE PROVISION AND AVAILABILITY

2.1 Service Components

PocketCoach provides:

·       AI-powered coaching conversations through text and voice interactions

·       Leadership development guidance using our proprietary 4-step framework:

a.     Structure – Organize thought processes for clarity

b.     Reflect – Review progress and challenges rationally

c.     Challenge – Address unproductive behaviors empathetically

d.     Call to Action – Develop clear resolution plans

·       Professional development support for managerial and interpersonal challenges

·       Session history within the application

2.2 Service Availability

·       We strive for 99% uptime but cannot guarantee uninterrupted service

·       Maintenance windows may temporarily limit access

·       Service availability may vary by geographic location

·       Features may be added, modified, or removed with reasonable notice

2.3 Technical Requirements

You are responsible for:

·       Compatible mobile device (iOS/Android)

·       Reliable internet connection

·       Updated app version

·       Appropriate device storage and performance

 

3. USER ACCOUNTS AND RESPONSIBILITIES

3.1 Account Creation

·       Provide accurate registration information (name, email, company)

·       Maintain the confidentiality of your account credentials

·       Notify us immediately of any unauthorized access

·       You are responsible for all activities under your account

3.2 Acceptable Use

You agree to use PocketCoach:

·       For professional development and coaching purposes only

·       In compliance with applicable laws and regulations

·       Without attempting to reverse engineer or compromise the Service

·       Respectfully, without harassment, discrimination, or abuse

3.3 Prohibited Uses

You may NOT use PocketCoach to:

·       Seek medical, psychological, legal, or financial advice

·       Handle emergency or crisis situations

·       Violate any applicable laws or regulations

·       Share inappropriate, offensive, or harmful content

·       Attempt to access other users’ accounts or data

·       Use the Service for competitive analysis or to build competing products

 

 

4. COACHING SERVICES AND LIMITATIONS

4.1 Nature of Services

PocketCoach provides coaching and mentoring services only. Our AI-powered coaching:

·       Focuses on professional development, leadership skills, and workplace challenges

·       Uses proven coaching methodologies and frameworks

·       Provides critical thinking prompts rather than direct solutions

·       Supports decision-making through structured reflection 

4.2 Important Disclaimers

NOT A SUBSTITUTE FOR PROFESSIONAL SERVICES:

·       PocketCoach is NOT medical, psychological, therapeutic, legal, or financial advice

·       We are NOT licensed healthcare, mental health, legal, or financial professionals

·       Do not use PocketCoach for medical conditions, mental health crises, or legal matters

EMERGENCY SITUATIONS:

·       If you are experiencing a crisis, contact local emergency services immediately

·       PocketCoach is not equipped to handle emergency or life-threatening situations

·       For mental health emergencies: Contact your local emergency hotline or emergency services

PROFESSIONAL LIMITATIONS:

·       We do not provide therapy, counseling, or clinical interventions

·       Coaching relationships are professional, not personal

·       Results depend on your engagement and application of insights

4.3 No Guarantees on Results

WE MAKE NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES REGARDING:

·       The effectiveness of our coaching services

·       Specific outcomes or results from using PocketCoach

·       Career advancement, performance improvement, or goal achievement

·       The suitability of our advice for your particular situation

·       Individual results may vary significantly

·       Success depends on personal effort, circumstances, and application

·       Past user experiences do not guarantee future results

·       We are not responsible for decisions made based on coaching interactions

 

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Our Intellectual Property

PocketCoach and all related content are protected by intellectual property laws:

·       Proprietary coaching frameworks developed by D Jungle People Sdn Bhd

·       AI algorithms and training models used in the Service

·       App design, user interface, and user experience

·       Trademarks: “PocketCoach” and related marks (pending/registered)

·       Content: All educational materials, prompts, and methodologies

5.2 User Content License

By using PocketCoach, you grant us:

·       Broad, worldwide, royalty-free license to your coaching session content

·       Rights to use, analyze, and process your interactions for service improvement

·       Permission to create anonymized insights from your conversations

·       Right to develop coaching methodologies, curricula, learning materials, training programmes, assessment and tools, professional and industry reports, thought-leadership and marketing materials based on aggregated user data

 

Your Rights:

·       You retain ownership of your personal information

·       You can access your conversation history

·       Personal identifiers are removed from analytical uses

·       You may request account deletion to terminate this license

5.3 Respect for Intellectual Property

·       Do not reproduce, distribute, or reverse engineer PocketCoach

·       Report any intellectual property violations to us

·       Respect third-party rights when using the Service

 

 

6. PAYMENT TERMS AND REFUNDS

6.1 Subscription Services

·       B2C Subscriptions: Pricing to be determined and displayed in-app

·       Free Trial Periods: Available for new users as specified

·       B2B Enterprise: Custom pricing through direct consultation

·       Payment Processing: Handled by third-party payment providers

6.2 Billing and Charges

·       Subscriptions automatically renew unless cancelled

·       Prices may change with 30 days’ notice to existing subscribers

·       Taxes may apply based on your location

·       Currency and payment methods vary by region

6.3 Refunds and Cancellations

·       Refund Policy: Upon mutual agreement between parties

·       Cancellation: You may cancel subscriptions through app store settings

·       Enterprise Agreements: Governed by separate contractual terms

·       No Refund Situations: Violation of Terms, account termination for cause

 

 

7. PRIVACY AND DATA PROTECTION

7.1 Data Collection and Use

7.2 Coaching Session Confidentiality

·       Coaching sessions: Available during active subscription

·       Account data: Retained until account deletion

·       Anonymized insights: May be retained indefinitely

8. LIMITATION OF LIABILITY AND DISCLAIMERS

8.1 Service Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND:

·       We disclaim all express and implied warranties

·       No warranty of merchantability, fitness for particular purpose, or non-infringement

·       No guarantee of accuracy, completeness, or reliability of content

·       Technology may have bugs, errors, or interruptions

8.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

·       Our total liability is limited to the amount paid for the Service in the preceding 12 months

·       We are not liable for indirect, incidental, special, or consequential damages

·       This includes loss of profits, data, business opportunities, or reputation

·       Limitations apply regardless of the theory of liability (contract, tort, negligence)

8.3 User Responsibility

YOU ACKNOWLEDGE AND AGREE:

·       You use PocketCoach at your own risk

·       You are responsible for decisions made based on coaching interactions

·       We are not responsible for outcomes from applying coaching insights

·       You must exercise personal judgment in professional situations

8.4 Third-Party Interactions

·       We do not screen or approve other users

·       We are not responsible for interactions outside the app

·       Enterprise clients manage their own user communities

·       Report inappropriate behavior through in-app mechanisms

 

 

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless D Jungle People Sdn Bhd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

·       Your use or misuse of PocketCoach

·       Violation of these Terms or applicable laws

·       Infringement of third-party rights

·       Any content you submit through the Service

·       Decisions made based on coaching interactions
 

10. TERMINATION

10.1 Termination by You

·       Cancel subscriptions through app store settings

·       Request account deletion by contacting customer support

·       Termination is effective at the end of your billing period

·       Downloaded conversation logs remain your property

10.2 Termination by Us

We may terminate or suspend your account for:

·       Violation of these Terms

·       Fraudulent or illegal activity

·       Extended inactivity (after reasonable notice)

·       Technical or business reasons

10.3 Effect of Termination

Upon termination:

·       Access to the Service immediately ceases

·       Your data will be deleted per our Privacy Policy

·       Accrued rights and obligations survive termination

·       No refunds for unused subscription periods (unless required by law)

 

11. DISPUTE RESOLUTION

11.1 Governing Law

These Terms are governed by Malaysian law, specifically:

·       Companies Act 2016

·       Personal Data Protection Act 2010

·       Consumer Protection Act 1999 (where applicable)

·       Digital signature and electronic commerce laws

11.2 Dispute Resolution Process

Step 1: Direct Communication

·       Contact customer support for issue resolution

·       We will respond within 7 business days

·       Good faith effort to resolve disputes amicably

Step 2: Mediation

·       Unresolved disputes may be referred to mediation

·       Conducted by recognized Malaysian mediation services

·       Costs shared equally between parties

Step 3: Arbitration/Litigation

·       Final disputes subject to Malaysian court jurisdiction

·       Kuala Lumpur courts have exclusive jurisdiction

·       Malaysian law applies to all proceedings

 

 

12. GENERAL PROVISIONS

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and D Jungle People Sdn Bhd regarding PocketCoach.

12.2 Modifications

·       We may update these Terms with reasonable notice

·       Continued use after changes indicates acceptance

·       Material changes will be prominently communicated

·       Enterprise agreements may have separate amendment procedures

12.3 Severability

If any provision is found unenforceable, the remaining Terms continue in full force and effect.

12.4 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

12.5 Assignment

·       You may not assign these Terms without our written consent

·       We may assign these Terms in connection with business transfers

·       Rights and obligations bind successors and assigns

12.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical infrastructure failures.
